B2B Caribbean Promotion

1. Organizing company

Lifealike Limited a limited company, registered in the United Kingdom under number 06554630 and its registered office at 5 Merchant Square, London, W2 1AY, trading under the brand “onefinestay” (hereinafter the "Organizing Company"), is organizing a free competition with no obligation to participate nor to purchase (hereinafter the "Contest") for B2B global partners from August 1st, 2022 at 9 am (GMT +1) to December 31st, 2022 at 11.59pm (GMT) under the name “B2B Caribbean Promotion”.

Scope of application

This Contest is exclusively offered to the Organizing Company's B2B partners who book with the Organizing Company in their Caribbean destinations between August 1st, 2022 at 9 am (GMT +1) and December 31st, 2022 at 11.59pm (GMT). Prizes will be awarded to Partners with the highest total Gross Transaction Value (GTV) during the Contest period. The Contest will be available in English exclusively. Full terms and conditions below.

The dates and times indicated in these rules refer to GMT (United Kingdom, Ireland). No other time zone will be taken into account for participation in the Contest.

Participation in the Contest is open to B2B individuals over the age of 18 (eighteen) with a partners (B2B) account in the Organizing Company's Salesforce(hereinafter the “Participant”), with the exception:

i. of the Organizing Company’s partners and subcontractors;

ii. of the family members of the persons listed in i, ii and iii;

iii. in general, of any company or natural person directly or indirectly involved in the Contest’s arrangement or organization; date of go live.

2. Knowledge and acceptance of the rules

These rules govern the implementation of the Contest and the selection of the winners.

Each Participant acknowledges having read the rules in their entirety and the principles of the Contest and accepts the conditions therein. Participation in this Contest shall be deemed to imply full and complete acceptance by the Participant of all the terms and conditions specified in these rules, the applicable online code of conduct, and the applicable laws and regulations regarding contests.

Failure to comply with any of the provisions of these rules will invalidate participation.

3. How to participate

To participate, the Participant must complete the following steps:

- Make a booking through the Organizing Company’s website or the Travel Advisors to the following destinations;

- St. Barts

- Turks and Caicos

- Barbados

- Jamaica

- Dominican Republic

- Anguilla

- Antigua

- Grand Cayman

- Grenada

- St. Martin

- British Virgin Islands

- US Virgin Islands

- Participate between August 1st, 2022 at 9 am (GMT +1) to December 31st, 2022 at 11.59pm (GMT);

- Stays happen in 2022, 2023 or 2024.

Each Participant can make a booking as many times as they would like in the stipulated destinations.

Each Participant is entered by making a booking in the above destinations. They can make as many bookings within August 1st, 2022 at 9 am (GMT +1) to December 31st, 2022 at 11.59pm (GMT) as they wish.

Fairness

- Open to all Organizing Company’s B2B partners who are set up in OFS Salesforce;

- The Contest is open globally;

- GTV is accumulated over time;

- Organizing Company will share the top 10 leaders of the Contest in a monthly newsletter to the Participants. Being identified by first name and company.

Naming the winners

The 6 winners will be indicated by looking at the highest GTV of bookings per Participant in the destinations indicated above on January 5th 2023 in London. This will be tracked through salesforce.

Prizes

The winners will be awarded the following 6 prizes in total:

(i) 1 x £5,000 (five thousand GBP) voucher to be used in any of the Organizing Company’s destinations they work in for a stay of their choice or

(ii) 5 x £1,000 (one thousand GBP) vouchers of the Participants choice.

Only one prize will be awarded per individual, among the top 6 Participants.

Each prize is awarded to an individual and may not be transferred, exchanged or modified.

Under no circumstances may financial consideration be requested as a substitution for the offered prize. The Organizing Company reserves the right, if circumstances so require, to replace this prize with another prize of equivalent value.

The Organizing Company cannot be held liable for the use of the prize by the winners. Any resale of the prize by the winners is strictly prohibited. The Organizing Company disclaims any liability for possible disputes relating to the terms and conditions pertaining to the awarding of the prize.

4. Notification of the winners

Each winner will be informed by email. No later than January 6th 2023 at 5 pm.

It is specifically noted that the provision of incomplete or inaccurate contact information will prevent the award of the prize without incurring the liability of the Organizing Company.

The winners will then have a period of 10 (ten) working days from the receipt of the Direct Message to contact the Organizing Company in order to collect their prize.

The Organizing Company will ask the winners the necessary personal information to organize the prize giving: first name, last name, country of residence, email address, voucher of choice (if necessary). In case of refusal to convey such personal data, the Organizing Company will consider such refusal as a waiver by the winner to accept the prize and shall not be held responsible for not fulfilling its obligations under these rules.

If no response is received by the aforementioned deadline, the Organizing Company will select a new winner, following the same procedures.

5. Right of scrutiny by the Organizing Company regarding the submissions

In order to ensure the appropriateness of the participations, the Organizing Company reserves the right to reject any participation whose content is deemed to be inappropriate or fails to comply with the conditions mentioned below.

The Participant guarantees that his/her participation:

- complies with the stipulations of these rules;

- contains no elements contrary to morality, public order or legal and/or regulatory provisions;

- infringes no third-party intellectual property rights (including the reproduction/representation of an item subject to intellectual property rights, such as an original work, without the express prior authorization of the rights holder, etc.);

- violates no individual rights (particularly against human dignity and rights relating to personality: right to a name, right to privacy, protection against defamation, insult or injury, protection against reproduction of an individual's image without their authorization, etc.);

- is of sufficient technical quality to be used in large format (sharpness/lighting);

- does not contain overtly political or polemical, pornographic, racist, hateful, offensive, advertising, promotional or commercial content.

6. Modification and cancellation of the Contest

The Organizing Company reserves the right at any time, if the circumstances so require, to interrupt, delete, postpone or defer the Contest and/or modify the procedures after informing Participants by any appropriate means without incurring any liability thereby.

7. Verification of entry validity

The Organizing Company reserves the right to perform all useful checks to ensure that each participation complies with all of the provisions set forth in these rules. To this end, the Organizing Company may, in particular, verify:

- the identity of the Participant;

- the Participant is entering from their work email address;

- the country of residence of the Participant.

8. Request for reimbursement

The Organizing Company agrees to reimburse upon request the actual and direct costs incurred to participate in the Contest to any Participant who makes such a request, namely the internet connection fees related to participation in the Contest and the postal charges related to the reimbursement request or transmission of payment, provided that invoices are duly submitted to the Organizing Company.

However, the Organizing Company commits only to reimburse the Participants who have complied with the conditions of participation in the Contest and the conditions set forth in this article.

For the purpose of simplification, the Organizing Company accepts only one overall request for reimbursement per household (same last name, same first name, same e-mail and postal addresses) and for the duration of the Contest.

9. Exclusion of liability of the Organizing Company

The Organizing Company reserves the right to suspend, postpone, extend or cancel the Contest without prior notice in the event of force majeure, following notification by all appropriate means. It shall not be held liable for doing so.

The Organizing Company may not be held liable for any disruptions to internet or electricity networks, incorrect use of the internet, failure of receiving equipment or any other incident affecting the smooth running of the Contest that could prevent a user from taking part before the deadline.

Participants are responsible for taking all the necessary steps to protect and secure their own data and/or software stored on their computer equipment against any attacks. Participants are fully responsible for their own connection to the page and their participation in the Contest. Any Participant attempting to tamper with the computer system of the Contest in any way whatsoever in order to win or to attempt to win will be disqualified from the Contest. In addition, the Organizing Company reserves the right to take legal action against anyone who has cheated or attempted to do so.

The Organizing Company may not be held liable for any damage or injury of any kind due to:

- malfunction of the website, computer errors or viruses or other problems that may cause damage;

- following events having the characteristics of force majeure (strike, bad weather, war, attack) that partially or totally deprive the winners of their prize;

- following any incident taking place to the winners during the enjoyment of their prize.

The Organizing Company cannot be held liable for the rejection of any participation that does not comply with all the provisions of these rules.

10. Placement and accessibility of the rules

The rules may be modified at any time by the Organizing Company in the form of an amendment available in the same conditions as the complete rules.

Any claim must be made ​​by email to the Organizing Company's general email address, [email protected], before January 2nd, 2022. After this date, no claim will be accepted.

The rules are sent free of charge to any person who so requests by mail at the address of the Contest before the close of the Contest (determined by the postmark).

11. Communication about the winners

The winners authorize the Organizing Company to use, publish and communicate they have won through their marketing channels.

12. Personal data

In accordance with applicable data protection regulations, information concerning you is processed Lifealike Ltd, the Organizing Company, acting as data controller. This processing is necessary for the purposes of performing this Contest, enabling your participation in the Contest to be taken into account, determining the winners and awarding prizes.

Your personal data is intended for use by the authorised personnel of the Organizing Company, for the purposes of managing the Contest and service providers for the only needs of organizing the Contest, selecting the winners and awarding the prize to the winners. Unless otherwise provided for by law or regulations, your personal data will be kept until the date on which the winners will receive their prizes.

13. Applicable law and language of the rules

These rules are governed by and subject to the provisions of British law, without prejudice to any mandatory protective provisions that may apply in the Participant’s country of residence.

These rules are written in English. In the event of a contradiction with any foreign language version, the provisions of the English version will prevail.

If any of the provisions of these rules is declared invalid and/or inapplicable, the other clauses will remain in full force and effect.

14. Competent jurisdiction

In the event of a dispute arising from the interpretation or enforcement of these rules, the Participant and the Organizing Company will use their best endeavors to reach an amicable settlement. In the absence of an amicable settlement, any litigation will be brought before the competent courts of London, UK.
