The company LIFEALIKE LTD., a UK company located at ℅ Forvis Mazars Llp The Pinnacle, 160 Midsummer Boulevard, Milton Keynes, Buckinghamshire, United Kingdom, MK9 1FF, (hereinafter referred to as “LIFEALIKE”, “we” or “us”), trading worldwide under the brand name “onefinestay”, publishes the website https://www.onefinestay.com (hereinafter referred to as the ”Platform“) and offers online luxury accommodation rental and Concierge Services, enabling users to book top-of-the-range houses and apartments for stays and benefit from curated luxury experiences.
These Terms of Use set out the legal framework governing the use of the Platform. We therefore ask you to read these Terms of Use carefully.
You acknowledge that by using the Platform and the Services, you have read and accepted these Terms of Use in full, without restriction or reservation.
We may modify the terms of these general Terms of Use at any time. You are invited to regularly consult these Terms of Use, which are permanently available on the Platform, in order to take note of any changes made to them.
If you do not accept all or part of any of the obligations or conditions contained in these Terms of Use, please do not use Platform and the Services offered therein.
ARTICLE 1 - DEFINITIONS
“Ancillary Services” refers to additional services offered alongside the property rental, such as insurance products for Guests or Homeowners, as well as other services to enhance the stay or provide protection (e.g., travel or home insurance).
“Ancillary Services Terms and Conditions” refers to the general terms and conditions governing the provision and use of Ancillary Services by LIFEALIKE, LIFEALIKE Subsidiaries or third party service providers.
“Booking” refers to the rental of a Property entered into between the Homeowner and a Guest, either directly or through a PMC.
“Booking Agreement” refers to the agreement the Guest enters into with the Homeowner, directly or through a PMC, to rent a Property.
“Concierge Services” refers to additional services as part of the property rental available during the Guest stay (e.g., concierge service, transport, catering, etc.).
“Concierge Services Terms and Conditions” refers to the general terms and conditions governing the provision and use of Concierge Services by LIFEALIKE, LIFEALIKE Subsidiaries or third party service providers.
“Guest” refers to a User with a registered User Account who wishes to search for and book a Property and/or request Concierge Services via the Platform.
“Guest Member” refers to any individual who will stay at the Property and benefit from its amenities through a Booking made by the Guest.
“Guest Terms and Conditions” refers to the general terms and conditions governing the Booking of a Property by the Guest.
“Homeowner” refers to a User with a registered User Account who wishes to publish and offer a Property for rent on the Platform, directly or through PMC.
“Listing Agreement” refers to the agreement entered into by the Homeowner with LIFEALIKE or one of LIFEALIKE Subsidiaries, either directly or through a PMC, which sets out the general terms and conditions governing the offering of a Property by the Homeowner.
“Platform” refers to the website accessible at address https://www.onefinestay.com, which we have developed and on which the User may create an User Account and/or access his/her personal User Account and/or use the Services.
“PMC” refers to a property management company that oversees the operations, maintenance, and rental management of Properties on behalf of Homeowners.
“Property” or “Properties” refer to properties offered for rental by Homeowners via the Platform.
“Property Standards” refers to the minimum standards a Property must meet and the basic level of service that must be provided to Guests for the Property to be listed on the Platform.
“Service(s)” refers to all the services and functions provided by LIFEALIKE via the Platform: listing a Property for rent, finding and Booking and providing Concierge Services.
“Subsidiary” or “Subsidiaries” refer to the onefinestay subsidiaries operating locally for regulatory purposes.
“Terms of Use” refers to the general terms and conditions of use governing access to and use of the Platform by the User.
“User” refers to any individual who accesses and uses the Platform as Guest, Homeowner or mere visitor, who may or may not have subscribed to the Platform newsletter, without a registered User Account.
“User Account” refers to the personal account created by a User in order to use the Platform and to access the Services.
ARTICLE 2 - DESCRIPTION OF THE PLATFORM
The purposes of the Platform is to:
present and describe services for the rental of Properties owned by Homeowners to Users.
enable Users or as the case may be their agents, to inquire about the rental of a Property, to book or request to book a Property, and to order Concierge Services. Please note for some Bookings additional terms and conditions may apply.
enable Users and/or their agents, to have their Properties marketed, managed, and rented through the intermediation of LIFEALIKE, directly or through one of its Subsidiaries. ARTICLE 3 - USE AND OPERATION OF THE PLATFORM
3.1 Registration
3.1.1 Browsing the Platform or consulting the pages do not require any registration on the part of the User.
3.1.2 However, in order to access and benefit from the Services offered by LIFEALIKE through the Platform or to receive the LIFEALIKE marketing campaigns, promotions, events or newsletters, the User is invited to create a personal User Account.
3.1.3 To create a User Account, the User must enter its first and last names, e-mail address and password.
When creating a User Account, User undertakes to provide us with data that is accurate, sincere and truthful. Any change to this information must be updated on the User Account.
We recommend choosing a password of at least 8 characters, made up of numbers, letters, capitals and symbols. This password remains personal and confidential and must not be shared with any third party in order to prevent any unauthorised connection to the Platform and use of the Services or the User Account.
3.1.4 If there are any doubts about the confidentiality of their password, the User must immediately change their password in order to protect the security of his or her User Account. The User must inform us immediately upon becoming aware of any breach of security or unauthorised use of his or her User Account.
3.2 User’s Responsibility
3.2.1 To open a User Account and use the Platform, the User must be at least 18 years and shall have the legal capacity to use, browse or register a User Account on the Platform.
The User shall not create or use any other User Account than the one initially created under his or her own identity.
3.2.2 The User is responsible for the information provided and LIFEALIKE cannot be held responsible for any errors resulting therefrom in the processing of the User's requests.
3.2.3 The User acknowledges and agrees that he/she will be solely responsible for all activities carried out on his/her User Account.
ARTICLE 4 - LISTING, RANKING AND DE-LISTING OF PROPERTIES
4.1 Conditions for Listing and Delisting/Deactivating Properties
LIFEALIKE uses its best efforts to select Properties in the world expressing the brand values on the basis of numerous criteria including but not limited to:
High-End Standards
Selected Properties meet high-end standards and are required to offer exceptional comfort, premium amenities and aesthetic appeal consistent with premium offerings. Properties that fall short of these standards due to wear, lack of upkeep, or outdated features may be deactivated.
Location and Surroundings
Properties are situated in desirable or exclusive areas that enhance the overall guest experience. Those in locations that become less appealing due to changes in the surrounding area may be deactivated.
Professional Standards
PMCs demonstrate high professionalism, reliability, and expertise and level of care and maintenance.
PMCs adhere to LIFEALIKE’s standards for Guest communication, check-in/check-out procedures, and overall guest experience and high standards of care.
Repeated complaints, poor guest reviews, or a lack of responsiveness may be deactivated.
Availability
The availability of the Property for Booking must be accurate, and in some markets exclusivity is a significant criteria in the selection process. Properties that do not offer a certain level of availability may be deactivated.

4.2 Ranking of the Properties
4.2.1 LIFEALIKE sets the features of the Properties. Their ranking is made automatically by the technical systems according to a number of criteria, as chosen by the User when browsing on the Platform and then by algorithm. Criteria may include the following:
Recommended
Properties that are highlighted based on a combination of factors, such as positive reviews, high booking frequency, and quality of amenities. These Properties are suggested as top choices for Users seeking a reliable and premium experience.
Recently added
Properties that have been newly listed on the Platform. This criterion allows Users to discover the latest additions to LIFEALIKE’s portfolio, featuring newly available locations or exclusive properties not yet widely booked.
Sleeps (most)
Properties that can accommodate the highest number of Guests. This criterion is useful for Users searching for large group accommodations, such as family reunions or group vacations.
Sleeps (fewest)
Properties that are designed for smaller groups or individual stays. This criterion highlights more intimate or exclusive properties suitable for solo travelers, couples, or small groups.
Price (lowest)
Properties ranked by the lowest price per night, helping Users with budget considerations find the most affordable options available on the Platform.
Price (highest)
Properties ranked by the highest price per night, typically featuring luxury estates, exclusive amenities, or prime locations, catering to Users seeking a premium or extravagant experience.
4.2.2 On the date of these Terms of Use, there is no shareholding relationship or remuneration between LIFEALIKE and the Homeowners or any PMCs that would influence the listing or ranking of the Properties listed on the Platform.
ARTICLE 5 - SERVICES
5.1 Listing and booking a Property
The formation of a Booking Agreement between a Homeowner and a Guest is facilitated via the Platform booking journey.

5.2 Concierge Services
LIFEALIKE or a Subsidiary, or as an intermediary to Concierge Service Suppliers, may offer Concierge Services, upon Guest or Guest Member request only, and in addition to the booking of a Property.
The provision of Concierge Services is subject to acceptance of the Concierge Services Terms and Conditions and/or the relevant third party Concierge Service provider’s terms and conditions by the Guest.
Such terms and conditions are communicated at the time of the Guest’s request.
5.3 Ancillary Services
LIFEALIKE or a Subsidiary, as an intermediary to service suppliers, may offer Ancillary Services, to enhance the stay.
The provision of Ancillary Services is subject to acceptance of the Ancillary Services Terms and Conditions and/or the relevant third party Ancillary Service provider’s terms and conditions by the Guest and/or Guest Member.
Such terms and conditions are communicated at the time of the Guest’s request.
ARTICLE 6 - OBLIGATIONS AND LIABILITIES
6.1 User Obligations
6.1.1 Users browse the Platform under their own responsibility. Users are required to browse the Platform in accordance with its intended purpose and in compliance with these Terms of Use, without undermining public order, public decency or the rights of third parties.
6.1.2 Users are responsible for the computer security of their equipment data and software, as well as for the network connection enabling them to access and use the Platform. In particular, Users are responsible for any loss of data or security breaches that may result from a virus or hacking.
6.1.3 Users agree it will not, will not attempt to, and will not assist or knowingly permit any third party to:
Use the Platform other than as expressly authorized in these Terms of Use,
Disassemble, decompile, reverse engineer, or otherwise attempt to reconstitute or discern or duplicate the Platform, the source code of the Platform, the algorithms, procedures, databases, or any portion of any of the foregoing accessible through the Platform, in each case for any purpose whatsoever.
Breach, disable, tamper with, or otherwise damage, the Platform, or any Services rendered or security measures either undertaken by LIFEALIKE in connection with or otherwise contained within the Platform,
Interfere or attempt to interfere (whether through a device, software, mechanism, routine or otherwise) with the proper working of the Platform or any of the Services rendered pursuant to or in connection with the Platform,
Alter or tamper with any information or materials on, or associated with, the Platform or any of the Services rendered by the Platform, or provided separately, or
Alter or modify in any manner whatsoever the Platform,
Upload, publish and/or share inappropriate content on the Platform or illegal, offensive to human dignity, of a sexual nature, defamatory, abusive, racist or any other content that may give rise to civil or criminal liability on the part of the person publishing it,
Use any content, data or process that could undermine the security of the Platform, personal data and, more generally, the image of LIFEALIKE and more generally the “onefinestay” brand.
6.2 Platform Performance
6.2.1 LIFEALIKE obligation to maintain the Platform is a best effort obligation. LIFEALIKE’s ability to provide access to the Platform and its availability may be impaired by conditions or circumstances that are beyond LIFEALIKE’s control.
6.2.2 LIFEALIKE reserves the right to modify the features of the Platform according to technical developments and may add, remove, modify and/or vary any elements of features and functionalities of the services without prior notice to Users.
6.2.3 In order to preserve the effectiveness and security of the Platform, LIFEALIKE reserves the right to suspend access, in particular temporarily or for reasons of maintenance to ensure the security of the Platform. The suspension will be lifted after verification of the conformity of the service. LIFEALIKE undertakes to ensure a level of security compatible with the technical standards of the industry. LIFEALIKE, which obligation is a best effort obligation as to computer security, cannot however guarantee the absence of modification, intrusion, alteration, unavailability of the service operated by a third party (person, virus ...).
6.3 Liability
6.3.1 LIFEALIKE may not be held liable if any non-performance or damage results from improper use of the Platform by the User or from a fault of the User, failing to comply with the requirements of Article 6.1.
6.3.2 Similarly, LIFEALIKE cannot be held liable for temporary or permanent loss or damage to the User's computer equipment or suffered as a result of accessing or browsing the Platform.
6.3.3 The transmission of data via the Internet may result in errors and/or the Platform not always being available. As a result, LIFEALIKE cannot be held liable for the availability and performance of the Platform, or in the event of bugs or technical incidents.
6.3.4 LIFEALIKE declines any liability for the following in particular:
Damage resulting from a failure by Users to comply with the rules and recommendations of LIFEALIKE in particular as set out in these Terms of Use;
Malfunctions, inability to access or poor operating conditions of the Platform, in particular due to improper equipment, disruptions due to the User’s access provider and/or congestion of the Internet network and/or for any other reason related to a force majeure event;
Unauthorized access to the Platform, computer virus infiltration, or other malicious acts by third parties.
6.3.5 In case of willful misconduct or gross negligence by LIFEALIKE, we shall only cover only direct, personal and actual damage suffered by the User.
ARTICLE 7 - INTELLECTUAL PROPERTY
7.1 The User may not reproduce, represent or adapt, directly or indirectly, the Platform, in whole or in part, in any form whatsoever. All intellectual property rights relating to any product or element of LIFEALIKE or “onefinestay”, such as trademarks, illustrations, photos, images, models and logos, whether registered or not, are and shall remain the exclusive property of LIFEALIKE.
7.2 Any total or partial reproduction, downloading, modification or use of LIFEALIKE or “onefinestay” brands, illustrations, images, photos, logotypes and models, for any reason and on any medium whatsoever, without the express prior written consent of LIFEALIKE, is strictly prohibited.
Similarly, the following are strictly prohibited, without the express prior written consent of LIFEALIKE:
the creation of hypertext links to any of the pages or any of the elements making up the Platform;
any use that does not comply with these Terms of Use to use the Platform and, in particular, the use of any of the elements making it up (items presented, descriptions, prices, data, software, graphics, images, texts, photographs, tools, etc.) for sale or any other use that is directly or indirectly commercial.
7.3 LIFEALIKE reserves the right to request the removal of any content or link to the Platform which has not been, or is no longer, authorized or which could be detrimental to LIFEALIKE.
ARTICLE 8 – DATA PROTECTION
As part of the User’s use of the Platform and Services, LIFEALIKE may collect, process and store personal data concerning the User.

ARTICLE 9 – AMENDMENTS
9.1 These Terms of Use come into force as soon as they are published on the Platform and remain in force until they are updated, in whole or in part, by LIFEALIKE. The amended Terms of Use come into force immediately on the date of their publication on the Platform.
The User expressly acknowledges that any use of the Platform subsequent to the update implies acceptance of the amended Terms of Use.
9.2 LIFEALIKE reserves the right to adapt, modify or update these Terms of Use at any time, particularly when needed due to legislative or regulatory changes. Within a reasonable time, LIFEALIKE will notify Users of any changes to the Terms of Use by email.
If the User chooses not to accept such amendments and updates, the User may terminate the agreement formed under these Terms of Use, at any time, at his or her discretion.
9.3 The cancellation for any reason whatsoever of any provision of these Terms of Use shall not in any way affect the validity of these Terms of Use as a whole.
ARTICLE 10 - SUSPENSION
LIFEALIKE may suspend, interrupt or limit any or all functionalities of the Platform or the User Account for the following reasons:
Technical maintenance: For reasons of maintenance, updating or improvement of the Platform or the Services, with reasonable notice where possible.
Violation of these Terms of Use: Any violation of the current Terms of Use by a User (e.g., inappropriate behaviour, malicious acts, etc.), causing negative consequences or damages to LIFEALIKE, to the Platform or to other Users.
Force majeure event: Due to unforeseen events beyond the control of LIFEALIKE.
In any cases, LIFEALIKE will do its best endeavours to notify the User, within a reasonable time, by pop-up when logging onto the Platform, etc..
ARTICLE 11 - APPLICABLE LAW - JURISDICTION
11.1 These Terms of Use of the Platform are governed by the laws of the United Kingdom.
11.2 Any dispute between LIFEALIKE and a User, relating to the present Terms of Use, will be brought before the Court of England to which jurisdiction is expressly granted in advance, even in the event of a third party claim or multiple defendants.
11.3 However, if the User is acting as a consumer, he or she cannot be deprived of his or her right to:
benefit from the mandatory rules of his or her country of residence.
bring proceedings before the Courts his or her place of residence.
Reciprocally, any proceeding brought by LIFEALIKE against the User acting, as a consumer, may only be brought before the Courts of the User’s place of residence.
