*Guest Terms of Service
*Terms of Use Terms and Conditions of Rental Guests booking through InvitedHome agree with InvitedHome, Inc. (“IH”) to be bound by these Terms and Conditions, all rules and regulations for the property (the “Property”) identified at the time of booking, and incorporates by reference the terms and conditions set forth at https://invitedhome.com/terms (the “Terms and Conditions”). If there is a conflict between the terms set forth in this Agreement, the Terms and Conditions, or the rules and regulations of the Property, the terms of this Agreement shall control.
*Property Rules. In addition to all rules, terms, and conditions described in this Agreement and at the time of booking, Guest (references to “Guest” in this Agreement shall include the Guest, all members of Guest’s party and all of Guest’s invitees) will comply with the rules posted at the Property or provided to Guest at or prior to check-in.
*IH Access to Property. IH reserves the right to access the property to perform inspections, repairs, maintenance, to show the Property, or in case of emergency. Advanced notice will be given whenever possible.
*Term. a. Arrivals and Departures. Guest shall have the right to use and occupy the Property commencing and ending on the dates and times shown at the time of booking. Guest is required to check-in and checkout according to the procedures specific to the Property, which will be provided to the guest prior to or at the time of check-in. IH, at its sole discretion, may agree to a change of dates only if the length of stay remains the same OR IS GREATER THAN THE ORIGINAL BOOKING and the checkout date remains within the same month as the original booking. A change of dates does not include Guest requests to add nights to their reservation. If the grand total resulting from a change of dates is more than the original booking, Guest is responsible for the cost difference. No refunds will be issued regardless of the new grand total. If the change is confirmed beyond the 24-hour grace period after booking, a fee of $75 will be charged at the time new dates are confirmed. b. Early check-ins/late checkouts: Check-in & checkout times are as shown at the time of booking. Entering and/or occupying the home before the check-in time shown at the time of booking may result in an additional charge or occupying the home "as-is" (i.e. without completion of the customary cleaning/inspection). The Guest may request an earlier check-in time or later checkout time by contacting IH. IH may grant requests in its sole and absolute discretion and at an additional fee. c. Non-compliance violation of checkout procedures: If Guest fails to follow the checkout procedures, IH reserves the right to charge Guest additional fees to recover costs resulting from such failure, including an additional day of rent. Guest understands that if the keys, garage door opener, and/or provided parking passes are not timely returned (the checkout time is stated at the time of booking), and/or if the Guest is still occupying the Property and/or designated parking areas after the checkout date & time listed at the time of booking, Guest is responsible and will be charged by IH for an extra night’s rental fee and tax, plus any additional losses suffered by IH or the owner of the Property (the “Homeowner”), including but not limited to the cost of alternative housing for travelers displaced by Guest’s holding over.
*Reservation costs, payments due, and payment schedule. At the time of your booking, the total cost of your reservation will be shown (the “Grand Total”) and an initial payment (the “Booking Deposit”) in the amount shown at the time of booking is due. The Booking Deposit shall be charged to Guest’s credit card (the “Guest Credit Card”) provided at the time of booking. The balance of the Grand Total (the “Final Payment”) is due in accordance with the payment schedule shown at the time of booking, and the Guest is responsible for making this payment on or before the due date. Should the payment become overdue, IH will automatically charge the card on file. Guest authorizes IH to charge the Guest Credit Card for the Final Payment (and any other amount due from Guest in accordance with the terms of this Agreement) when due. If the Guest fails to timely make any payment when due, or if the Guest Credit Card declines any charge by IH for any reason, IH reserves the right to terminate this Agreement. In addition to any other remedy IH may have against Guest in the case of such a termination, IH may retain all amounts previously paid by Guests.
*Travel Insurance: Protect the travel investment you are making by purchasing trip cancelation insurance, and you can protect your travel investment if an unforeseen event such as illness, mandatory evacuation, travel delay, or other insured event should occur. Guest agrees that optional travel insurance was offered at the time of booking with the option to purchase or decline. Purchasing travel insurance is not required in order to purchase any other products or services offered by IH. In accordance with the Cancellation Policy as described at the time of booking, any changes to the reservation not covered by Guest’s travel insurance policy are the responsibility of Guest. *Cancellation. Cancellations must be submitted in writing or email and received by IH to the addresses provided in the e-mail sent to you when you complete your reservation. Cancellation policy agreed by guest at the time of booking carries with the reservation until check-in, regardless of any company changes. There are no refunds or credits for late arrivals, early departures, no shows, Guest family emergencies, weather, snow conditions, airport closures, or road closures. IH strongly recommends you secure your vacation reservation with adequate travel insurance.
*Property Damage / Violation of Property Rules. Guest is liable for any and all damage to the Property and its contents, including furnishings, electronics and fixtures, and the common areas of the Property, due to negligence, neglect, or abuse by Guest and any occupant or invitees (including any extra cleaning or repairs required, in IH’s discretion). Guest shall keep and maintain the Property and its contents, including electronics, furniture, and fixtures in a clean and sanitary condition at all times, and upon termination of the Term surrender the Property and its contents, including electronics, furniture, and fixtures in as good a condition as when received, ordinary wear and tear excepted. Guest’s liability includes, but is not limited to: (a) the cost of repairs to or replacement of the Property and its contents, including electronics, furnishings, and fixtures damaged during the Guest’s stay; (b) the cost for any excessive cleaning required after the Guest’s departure should the home not be left in as good a condition as when received; (c) any non-compliance with the checkout procedures; (d) smoking of any substance in or on the Property or its common areas (a fee of $1,500 plus cost of any associated damages or additional cleaning); (e) unauthorized animals being brought in or on the Property (a fee of $500 plus cost of any associated damages or additional cleaning); (f) replacement of keys, garage door openers, and/or parking passes that have been lost or are not returned, and the associated re-keying costs for security purposes, and (g) the cost of alternative housing for travelers displaced by Guest’s negligence, abuse, or misuse of the property. If the Guest has paid the accidental damage waiver fee shown at the time of booking, IH waives its right to recover from the Guest the first $3,000.00 in damages caused by Guest or Guest’s invitees. Notwithstanding the foregoing, the Guest shall be liable for any and all damage caused by Guest’s (or Guest’s invitees) intentional misconduct, misuse, gross negligence, or violation of the Property Rules (each an “Excluded Cause”). If Guest is responsible for the cost of any damage, the amount of such damage shall be deducted from the Damage Deposit (as defined below), with any excess charged to the Guest Credit Card.
*Animals. Animals are permitted in certain properties, however, only if IH gives prior written approval of the specific animal (any additional or different animal will require separate written approval), and Guest complies with the following: (a) all Property restrictions and rules regarding animals must be complied with at all times; (b) Guest must pay IH an accompanying non-refundable animal fee as set by IH and the homeowner; Guest authorizes IH to process such charge(s) to the Guest Credit Card at the time of booking. (c) Guest is responsible for any damage to the Property and common areas of the Property caused by the animal; (d) Guest must manage his/her animal, including immediately cleaning up after it in the Property and the common areas of the Property; (e) The animal may not disturb the peace by barking, howling, whining, crowing, baying, or making any other loud and persistent or loud and habitual noise; (f) animal must be confined during periods when IH employees or other contractors are scheduled to visit. Guest will be asked and may be required to remove the animal from the Property if there are any violations of these rules. Costs associated with removal and/or boarding are the responsibility of Guest. IH may terminate this Agreement if Guest violates the terms of this Section or refuses to comply.
*Smoking. Guest understands that smoking of any substance is not permitted in the Property or in the common areas of the Property. Guest understands that a fee of $1,500.00 will be charged, in addition to any associated damages and additional cleaning if smoke is detected in the Property at any time.
*Care of Property. Guest agrees to take good care of the Property and not to perform any hazardous, offensive, or unlawful activity in the Property or the common areas of the Property. Guest agrees and acknowledges that IH will not be responsible for safe-keeping of equipment, supplies, written material, vehicles, personal belongings, or other valuable items left in the Property or common areas of the Property.
*Refundable Security Deposit. At the time of check-in, IH will run an authorization hold on the Guest Credit Card in the amount indicated at the time of booking (the “Damage Deposit”). Guest authorizes IH to process such charge(s) through the Guest Credit Card. The Damage Deposit will be released or charged, less any amount due under Section 7 or any other provision of this Agreement, not more than 15 business days after your departure date. The Damage Deposit will be charged in the amount indicated at the time of booking and any applicable refund may be delayed if there are damages to evaluate. If Guest is responsible for the cost of any damage in excess of the Damage Deposit, the excess amount will be charged to the Guest Credit Card. IH reserves the right to recuperate excess charges from Guest once repair costs are completed, or a settlement for damage has been reached.
*All rentals are to families and responsible adults only. All persons occupying the Property must meet the minimum age specified at the time of booking or be accompanied by a parent or legal guardian. Guest acknowledges that he/she will personally occupy the Unit for the entire term of this Agreement and will not sublet any portion of the Unit. OCCUPANCY IS RESTRICTED TO THE MAXIMUM OCCUPANCY, AS SET FORTH at the time of booking. The party intended to stay upon booking should not be altered or changed without notifying IH and receiving written permission from IH of change. Guest agrees that the Property shall not be used for any illegal or hazardous purpose. Occupancy and use of the Property in a manner that disturbs or offends neighboring residents shall be deemed grounds for termination of this Agreement and immediate removal of Guest from Property. In addition to any other remedies available to IH, this Agreement may be terminated, and a fee of $500 may be charged to Guest (and the Guest Credit Card) if there are any complaints to the Police Department or governing body concerning the behavior of the Guest, Guest’s family, other occupants, guests, or visitors while occupying the Property.
*Termination. IH reserves the right to terminate this Agreement and provide the Guest a full refund prior to Guest’s arrival if IH determines the Guest and his or her invitees are not an appropriate fit for the Property. If the Guest or any member of his or her party violates the Property Rules or any term of this Agreement, IH may terminate this Agreement with no refund of the unused portion of the Grand Total and IH, the police, or another agent of IH may enter the Property and remove Guest, the members of his or her party, and their belongings.
*Events. Events are defined as any use of the Property in which the number of people on the Property at any given time is greater than the maximum occupancy stated at the time of booking, and/or any use in which any part of the Property is substantially altered by the use of decorations, use of additional furniture, or rearrangement of furniture or furnishings. ADDITIONAL DEFINITIONS of events include, but are not limited to parties, weddings or associated activities, group dinners, bachelor parties, bachelorette parties, birthday parties, and reunions. All events must be approved in writing by IH at the time of booking. The holding of an Event at the Property is not allowed without expressed written permission from IH and shall be deemed grounds for termination of this Agreement and immediate removal of Guest from Property and an Unapproved Event Fee of $15000 minimum shall be charged to Guest (and the Guest Credit Card), in addition to any other remedies available to IH. The cost of repairing any damage and additional cleaning caused to the Property during any approved or unapproved Event will be the responsibility of the Guest, and will be charged to the Guest Credit Card.
*Parking & Vehicles. Guest shall be entitled to park only in parking spaces designated to be utilized by the owner of the Property. The maximum number of vehicles may not exceed the number listed at the time of booking. Guest is responsible for ensuring that all occupants and invitees park their vehicles in compliance with applicable law and the rules of any homeowners association of similar entity and to avoid causing a hazard or impediment to passing traffic, pedestrians, snow removal operations, and or shared driveways. IH does not guarantee oversized or large vehicles or trailers will fit within the Property’s designated parking areas. Alternative parking arrangements and costs associated to park vehicles exceeding the maximum number of cars listed at the time of booking or oversized vehicles or trailers are the responsibility of Guest. IH is not responsible for any parking tickets received by Guest or towing expenses due to weather or parking violations.
*Pool & Spa. The Property may contain a swimming pool, hot tub, jetted tub, or steam shower/room (collectively, a "Pool or Spa”). Guest is responsible for any and all damage to the Pool or Spa. Minors may not use the Pool or Spa without direct adult supervision. Guest agrees to abide by all rules, hours, and instructions for the use of Pool or Spa provided at the Property or in materials provided by IH. Guest acknowledges and agrees that if for any reason a Pool or Spa malfunctions, Guest is solely responsible for notifying IH staff using the contact information provided to Guest in check-in instructions or posted in the Property. Guest further understands and acknowledges that overuse of a Pool or Spa may cause the Pool or Spa to shut off and may result in damage to the Pool or Spa, including the burn out of jets and motors in the Pool or Spa system. Under no circumstances shall Guest remove or add water or attempt to drain a Pool or Spa. Unfortunately, there are occasional problems with Pools & Spas. IH will use reasonable efforts to minimize any interruption in the case of a problem, but in the case IH is unable to repair the Pool or Spa, no refunds will be given. In the case that a community Pool or Spa is unavailable for Guest use, no refunds will be given.
*Television and internet. Guest agrees that IH cannot guarantee the availability of internet or television services, as interruptions occur from time to time that are beyond IH control. No refunds will be given due to interruptions of these services. Guest is responsible for the cost of any pay per view or similar items ordered during the term of Guest’s stay. Guest agrees to use the internet in accordance with all laws, and Guest is responsible for any costs or fines associated with illegal use of internet services.
*Phone Service. The Property may not have phone service, and cell phone service cannot be guaranteed. No refunds will be given due to interruptions of service.
*Heating and air conditioning. Guest agrees not to set the heat above 78 degrees or the air conditioning below 70 degrees. Guest is responsible for the repair of damage that occurs to HVAC systems due to violation of this rule. The Property may contain a fireplace. Unfortunately, there are occasional problems with fireplaces. IH will use reasonable efforts to minimize any interruption in the case of a problem, but in the case IH is unable to repair the fireplace(s), no refunds will be given.
*Unavailability. If IH is unable to deliver the Property to Guest prior to or during occupancy under this Agreement because of fire, eminent domain, act of nature, delay in construction, repairs, unavailability, technological errors, sale of Property, loss of heat or hot water, or any other reason whatsoever (collectively, “Unavailability”), Guest hereby agrees that IH may, at its option and as Guest’s sole and exclusive remedy, offer a substitute accommodation OR refund of all fees previously paid by Guest. If Guest choses alternative accommodations, Guest agrees to pay the difference if cost is greater than original booking. If guest chooses a refund, IH will refund all fees paid prior to arrival but will prorate and refund unused fees paid if IH is unable to deliver the Property during occupancy. The foregoing is Guest’s exclusive remedy for IH’s failure to perform due to Unavailability.
*Use restrictions. This Agreement, and the Guest’s occupancy of the Property, is subject, at all times, to any rules set forth by any Home Owners Association governing the Property use, including, without limitation, that certain Declaration of Covenants, Conditions, and Restrictions recorded against the Property (the “CC&R’s”) and any rules and regulations applicable to the Property which have been established by the applicable Home Owners Association. Any failure by the Guest to comply with the terms of such restrictions shall be a breach of this Agreement. Upon request, IH will provide the Guest with a copy of any such use restrictions applicable to the Property that are not already addressed in this Agreement. If there is a conflict between or among the provisions of the CC&R’s, any rules or regulations established by the Home Owners Association, or any other rules, regulations or guidelines established by IH with respect to the Property, the more restrictive of such conflicting provisions, rules, and/or regulations shall be deemed to control.
*Lost, stolen or abandoned articles. IH and the Homeowner shall have no responsibility for any personal Guest property lost, stolen, or abandoned from or at the Property. Found items will be held for a maximum of 30 days from the date of checkout and will then be donated if Guest does not contact IH to claim item(s), provide a shipping address, and complete payment of lost and found fee within this timeframe. Guest will incur a $25 lost and found fee in addition to the actual costs incurred to have items returned.
*Assignment, Subletting, Amendments. Guest may not assign, sublease, or transfer any rights under this Agreement, including the right to occupy the Property or any part thereof or permit the use of the Property by anyone other than the Guest and a number of invitees such that the total number of occupants does not exceed the maximum stated at the time of booking. Guest may not make any amendments to this Agreement. This Agreement may be superseded only by written terms laid out to Guest by IH at the time of booking.
*Indemnity. Guest will defend, indemnify, and hold IH and its employees and affiliates and the Property Owner harmless for any claims, Losses arising from Guest's and occupant's or invitee's use of the Property or the common areas of the Property, or breach of any term of this Agreement (each a “Claim”). “Losses” means any and all claims, judgments, damages, penalties, fines, costs, liabilities, losses or expenses (including, without limitation, reasonable attorneys’ fees and expenses) incurred by IH or its affiliates by reason of or arising from a Claim.
*Limitation of Liability. Guest acknowledges and agrees that his / her use of the Property or any of the facilities or amenities shall be entirely at Guest’s risk for all purposes and circumstances. To the fullest extent permitted by applicable law, use of the IH’s Website and rental and use of the Property is at Guest’s sole risk, and Guest waives any and all claims s/he may have against IH and the Homeowner in connection with the transactions contemplated by this Agreement. IN NO EVENT SHALL IH BE LIABLE FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS, REVENUE, GOOD WILL OR LOSS OF USE OR DATA) ARISING OUT OF OR RELATED TO IH’S PERFORMANCE (OR FAILURE TO PERFORM) ITS OBLIGATIONS UNDER THIS AGREEMENT, EVEN IF IH HAD BEEN ADVISED, KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES OR COSTS.
*COVID-19 Waiver. Guest acknowledges the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. Guest further acknowledges that IH has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. Guest further acknowledges that neither IH nor the homeowner can guarantee that Guest will not become infected with the Coronavirus/Covid-19 during the Guests’ stay. Guest understands that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, IH staff, and other IH clients and their families. Guest understands these risks and knowingly and voluntarily assumes all risks associated with Guest’s stay and Guest waives any and all claims s/he may against IH and the homeowner related to COVID-19 or otherwise in connection with the transactions contemplated by this Agreement.
*Disclaimer. The services are provided without any other warranties of any kind and IH and Homeowner specifically disclaim all warranties, whether express, implied, or statutory, including, without limitation, all implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and any warranties arising from course of dealing or course of performance. By checking the “I agree” box on the Booking Page, Guest acknowledges that he/she has reviewed and understands the terms of this Agreement and agrees to be bound thereby.
